These Terms of Service ("Terms") govern your use of AuctusMed's services. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully.

Services

AuctusMed provides marketing automation services for independent aesthetic medical practices, including automated SMS messaging, appointment reminders, review generation, patient reactivation systems, and related reporting. Services are provided on a subscription basis.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring all communications sent through our platform comply with applicable laws, including but not limited to:

• The Telephone Consumer Protection Act (TCPA)
• The CAN-SPAM Act
• All applicable state and federal regulations governing patient communications

You must obtain proper consent from patients before enrolling them in automated communications through our platform.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Payment Terms

Services are billed monthly in advance. Payment is due at the start of each billing period. You may cancel your subscription at any time. No refunds are issued for partial months of service. We reserve the right to suspend services for accounts with overdue payments.

Founding Member Pricing

Founding member pricing is available to the first 20 clients who subscribe. Founding members retain their locked-in rate for as long as their subscription remains active and in good standing. AuctusMed reserves the right to adjust pricing for new subscribers at any time.

Intellectual Property

AuctusMed retains all rights to its platform, automations, and proprietary systems. You retain ownership of your business data and patient information. By using our services, you grant AuctusMed a limited license to process your data solely to provide the services described.

Limitation of Liability

AuctusMed's total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid for services in the preceding one-month period. We are not liable for indirect, incidental, special, or consequential damages of any kind.

Disclaimers

Our services are provided "as is" without warranties of any kind. We do not guarantee that our services will be uninterrupted or error-free. We are not responsible for decisions made based on information or reports generated by our platform.

Termination

Either party may terminate the service relationship at any time. Upon termination, your access to the platform will cease at the end of your current billing period. We reserve the right to terminate accounts that violate these Terms.

Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
